ODFW filed for water rights in 1991 in order to insure maintenance of Borax Lake elevation. The water right was certified in 1998. Over the past 16 years, ODFW managers have not taken action to maintain the lake level and their water right which optimizes habitat conditions. ODFW has committed to maintain the water right to assure the elevation of Borax Lake is high enough for water to connect to the "marsh" area described in the listing rule. This habitat is important refuge habitat for Borax Lake chub when lake water temperature gets too hot for chub survival. Groundwater outside of the TNC land is still not protected. There are no direct costs to withdraw water from appropriation.

To adjust the lake levels after the shoreline was chipped, ODFW installed sand bags at the outlets to maintain the lake water elevatio so that water flowed out of the southeast edge into the area described as the "marsh" and which provides additional habitat for Borax Lake chub. This habitat serves as refuge when the lake water temperature is elevated. The ODFW aquirerd a water right at the lake for conservation purposes which is set at 4,081 feet, an elevation which should provide water to the marsh. The estimated agregate flow is 2 cfs which is intended to flow into the marsh, but allow excess flow out of the north side of the lake for important water bird nesting habitat.
